If you arrived on time at the boarding gate and your documentation was in order, you can and should claim. Even if you were boarded on a different plane. As long as you didn’t voluntarily avoid boarding the plane. And if you arrived at your destination with, at least, a 3-hour delay.

Generally, if you are in Spain for less than 183 days per year, you are not considered a resident for tax purposes. However, there are exceptions. For instance, if your spouse and children live in Spain. Or if the Spanish tax office believes that your core economic interests are in Spain, although this is difficult to determine.
